Marketing Communications & Contact Preferences Notice

This Notice explains how CatchJobs manages direct marketing and contact preferences for users in the United Kingdom and, where relevant, users in other jurisdictions. It should be read together with our Contact Terms and Privacy Policy.

About this Notice

This Notice applies to direct marketing and optional promotional communications sent by or on behalf of CatchJobs, including e-mails, SMS or text messages, push notifications, in-Platform promotional messaging, and live telephone marketing calls where those channels are used.

It distinguishes marketing communications from service, operational and account-related communications. Service and operational communications are not direct marketing and may still be sent where necessary to provide the Platform or administer your account.

How the UK framework works

In the UK, direct marketing by electronic mail and telephone is regulated primarily by the Privacy and Electronic Communications Regulations 2003 (as amended) ("PECR"), alongside the UK GDPR and other applicable data protection laws.

There is no UK-wide central opt-out register for marketing e-mails or text messages equivalent to the Turkish IYS model. Instead, organisations must rely on valid consent or another rule that PECR permits, such as the soft opt-in for certain communications to existing customers, and must provide a clear opt-out mechanism in each marketing message.

For live marketing calls, the UK uses the Telephone Preference Service ("TPS") and the Corporate Telephone Preference Service ("CTPS") as statutory opt-out registers for numbers that do not wish to receive unsolicited live marketing calls.

When we may send marketing e-mails or text messages

Where the recipient is an individual, we will only send direct marketing by e-mail or text message where we are entitled to do so under applicable law. In practice, this usually means either that you have given us specific consent, or that the PECR soft opt-in rule applies to our own similar services and you were given a clear opportunity to opt out when your details were collected and in every subsequent message.

We will identify ourselves in our marketing messages and will include a clear method for opting out, such as an unsubscribe link or another equivalent mechanism.

If you opt out, we will stop sending the relevant marketing communications as soon as reasonably practicable and will keep sufficient records to make sure your preference is respected.

When we may make live marketing calls

For most categories of live marketing calls, PECR does not always require prior consent. However, we must not call a number for live direct marketing if that number is registered with the TPS or CTPS, or if the subscriber has previously told us that they do not wish to receive such calls from us.

If a number is registered on the TPS or CTPS, we will only call it for live direct marketing where the subscriber has specifically told us that they wish to receive marketing calls from CatchJobs notwithstanding that registration, or where another lawful exception clearly applies.

Where live marketing calls are made, we will identify ourselves and provide the information that the law requires.

Preference management

Users can manage marketing preferences by using the unsubscribe or equivalent mechanism included in a marketing message, by changing settings within the Platform where those settings are available, or by contacting us directly.

Opting out of marketing communications will not normally prevent you from receiving service, operational, billing, security or recruitment-process communications that are necessary for the use of the Platform or for a role you have chosen to pursue.

Where a channel-specific opt-out is requested, we may continue to communicate through a different channel for non-marketing purposes where that remains necessary and lawful.

Third party campaigns and list management

We will not share your personal data with third parties for their own direct marketing unless you have separately agreed to that use.

If we run a co-branded campaign, referral campaign, event campaign or other joint activity with a third party, we will make the relevant roles and uses clear at the time and, where required, obtain any necessary consent.

We may maintain internal suppression lists, unsubscribe lists and objection records so that we can honour preferences and avoid contacting people who have opted out or objected.

Evidence and compliance records

We may retain records of consent statements, the date and source of collection, preference changes, unsubscribe events, delivery logs, campaign records, TPS or CTPS screening activity, and complaint handling records in order to demonstrate compliance, respond to queries and protect the Platform and its users.

How this Notice relates to other documents

This Notice supplements, and does not replace, the CatchJobs Contact Terms and Privacy Policy. The Contact Terms explain the wider rules for communications sent by or through the Platform. The Privacy Policy explains how associated personal data is collected, used, stored and shared.
